Established in 1921, the Philadelphia Asbestos Corporation (PACOR) Incorporated soon became a top supplier of insulation, pads, and pipe coverings. In 1986, Pacor Incorporated filed for Chapter 11 bankruptcy in response to the countless number of asbestos claims received by the company. As part of its reorganization plan, the company established the Pacor Settlement Trust. Initially funded with $2.5 billion, the trust currently pays out 5.1% on asbestos claims. This trust is part of the Manville Personal Injury Settlement Trust.

The History of Pacor Incorporated

Established in 1921, Pacor’s services were first focused on the industrial rather than consumer market. During World War II, Pacor also provided insulation to the US Navy. The court in this case determined that the victim’s lawsuit was not “related to” Manville’s bankruptcy and consequently that the claim could not be moved to the Manville bankruptcy administration. The court in the case established the “Pacor test,” which finds that a claim is connected to a bankruptcy case if the case’s outcome could impact the bankruptcy estate.
• In Hanna v. Pacor Inc., the administrator of an estate initiated a product liability claim against PACOR seeking compensation as the result of a deceased worker’s exposure while at Pacor. Because the court found that this action was not related to Pacor’s bankruptcy, the court affirmed the order of the district court which remanded the action to the Pennsylvania Court of Common Pleas.
